Dream Wild Studio VIP Design Day Terms & Conditions

These Terms & Conditions apply to VIP Design Day services provided by Martina Zavacka, a sole trader trading as Dream Wild Studio, based in Belfast, Northern Ireland.
VIP Design Days are professional design services intended for businesses and individuals purchasing the service primarily for business purposes.
1. Booking & Payment
A 50% deposit is required to secure your VIP Design Day.
Your booking is confirmed once the deposit has been received and your date has been agreed.
The remaining 50% balance must be paid before your scheduled VIP Design Day. Dream Wild Studio is not required to begin work where the full balance remains unpaid.
By paying the deposit, you confirm that you have read and agreed to these VIP Design Day Terms & Conditions.
2. Rescheduling & Cancellations
VIP Design Day bookings are non refundable due to the dedicated time reserved specifically for your project.
You may reschedule your VIP Design Day by providing at least 7 days notice before your scheduled date.
Any rescheduled VIP Design Day must take place within 3 months of the original booking date, subject to Dream Wild Studio availability.
Requests to reschedule with less than 7 days notice may result in the booking and payments already made being forfeited.
If Dream Wild Studio needs to reschedule due to illness, emergency or circumstances outside reasonable control, you will be offered an alternative date. If a suitable alternative cannot be agreed, any payment relating to the undelivered VIP Design Day will be refunded.
Nothing in these Terms affects any rights that cannot legally be excluded.
3. Pre Day Preparation
All content and materials required for the agreed work must be supplied before your VIP Design Day.
Depending on the project, this may include website copy, images, branding files, login details, fonts, platform access and other relevant information.
Dream Wild Studio will confirm what is required before your scheduled date.
If required content, access or materials are not supplied in time, Dream Wild Studio may reschedule the VIP Design Day. If the delay is caused by the client, the rescheduling terms above will apply.
4. Scope of Work
Before the VIP Design Day, we will agree on the main priorities for the day.
A VIP Design Day is a time based service. Dream Wild Studio will dedicate the agreed working day to your project and work through the agreed priorities in order of importance.
The amount of work completed will depend on the complexity of the project, the materials supplied, the speed of feedback and any technical limitations encountered during the day.
The booking does not guarantee that every requested task will be completed within one VIP Design Day.
Requests outside the agreed priorities may require additional time, a separate service or another VIP Design Day.
5. VIP Day Delivery
Communication will take place throughout the VIP Design Day using the communication channel agreed before the project begins.
You are expected to remain reasonably available during the day to provide feedback, answer questions and approve work where required.
Delays in client feedback may reduce the amount of work that can be completed during the allocated time.
Final files relating to completed work will normally be delivered within 24 hours following the VIP Design Day unless another timeframe has been agreed.
6. Post Day Refinements & Support
Your VIP Design Day includes up to 1 hour of refinements to work completed during the day.
Refinement requests must relate to the agreed VIP Design Day work and must be submitted within 7 days following completion of the VIP Design Day.
The service also includes 7 days of email support for reasonable questions relating to the completed work.
New concepts, additional pages, additional functionality, new design requests or work outside the original scope are not included in the refinement time and may be quoted separately.
7. Client Responsibilities
You are responsible for providing accurate information, content, materials and access required to complete the work.
You confirm that you have the necessary rights, permissions and licences to use any copy, photographs, graphics, fonts, trademarks, software or other materials supplied to Dream Wild Studio.
You remain responsible for reviewing and approving final content, spelling, information, links and functionality before publication or use.
8. Third Party Services
Some projects may involve third party platforms, software, plugins, fonts, stock images, hosting providers, email platforms or other external services.
Unless specifically included in your agreed scope, any third party subscriptions, licences or fees are the responsibility of the client.
Dream Wild Studio is not responsible for changes, outages, restrictions or failures caused by third party platforms or services outside its reasonable control.
9. Intellectual Property
Once the VIP Design Day has been paid in full, you will receive the rights to use the final original design work created specifically for your business, unless otherwise agreed in writing.
Dream Wild Studio retains ownership of working files, unused concepts, design processes, methods, templates and other materials that were not created exclusively as final client deliverables.
Fonts, stock imagery, software, plugins and other third party materials remain subject to their respective licences and ownership terms.
Dream Wild Studio may display completed work as part of its portfolio, website, social media and promotional materials unless otherwise agreed in writing.
10. No Guarantee of Business Results
Dream Wild Studio will provide the service with reasonable skill and care.
No specific commercial result is guaranteed from the design work, including increased sales, enquiries, conversions, website traffic, revenue or business growth.
11. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
To the fullest extent permitted by law, Dream Wild Studio will not be responsible for indirect or consequential loss, loss of profit, revenue, business, opportunity, anticipated savings, goodwill or data arising from the VIP Design Day services.
Dream Wild Studio will not be responsible for losses caused by client supplied materials, incorrect information, third party services, changes made by the client or another provider after delivery, or circumstances outside Dream Wild Studio’s reasonable control.
12. Governing Law
These Terms are governed by the laws of Northern Ireland.
For clients purchasing the VIP Design Day for business purposes, the courts of Northern Ireland will have exclusive jurisdiction over disputes arising in connection with the service.
13. Changes to These Terms
Dream Wild Studio may update these Terms from time to time.
The version in effect when your VIP Design Day is booked will apply to your booking. Changes made after your booking will not retrospectively change the terms of your existing booking unless agreed in writing or required by law.
